1. Acceptance of Terms
By creating an account or using COMMAND ("the Platform"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree, do not use the Platform. These Terms constitute a binding legal agreement between you and AndCap.
2. Description of Service
COMMAND is a personal financial operating system designed to help users organise and visualise their cashflow, net worth, goals, habits, and financial directives in one place.
The Platform is a financial organisation and planning tool only. It does not provide, and should not be construed as providing, personalised financial advice, investment advice, tax advice, legal advice, or any regulated financial service under the Corporations Act 2001 (Cth) or any applicable Australian legislation.
Any information, projections, scores, or outputs generated by the Platform are for organisational and illustrative purposes only. They are based entirely on data you enter and reflect no independent assessment of your circumstances.
3. No Financial Advice
3.1 Nothing on the Platform constitutes financial product advice as defined under the Corporations Act 2001 (Cth).
3.2 COMMAND does not hold an Australian Financial Services Licence (AFSL) and is not required to do so for the services it provides.
3.3 Any financial outcomes — including achieving savings goals, improving cashflow, or building net worth — depend entirely on your own decisions and actions. The Platform provides tools and frameworks to support your thinking. It does not guarantee any financial outcome.
3.4 You should seek advice from a licensed financial adviser before making significant financial decisions.
4. Limitation of Liability
4.1 To the maximum extent permitted by law, AndCap excludes all liability for any loss or damage — whether direct, indirect, consequential, or incidental — arising from your use of or reliance on the Platform, including but not limited to: financial loss of any kind, loss of data, missed financial goals or outcomes, or decisions made based on Platform outputs.
4.2 Where liability cannot be excluded under applicable law (including the Australian Consumer Law), AndCap's liability is limited to the greater of: resupply of the service; or the total subscription fees paid by you in the three (3) months preceding the event giving rise to the claim.
4.3 COMMAND is a platform that collates your data and allows you to plot a path for the future. It does not offer personalised financial advice or any guarantees of achievement — that rests on your individual actions. COMMAND accepts no liability for damage caused as a result of using the Platform.
5. Your Data and Privacy
5.1 COMMAND stores personal and financial data you choose to enter. This data is stored securely via Supabase, a third-party database provider operating under industry-standard encryption and security practices.
5.2 We do not sell, share, or use your personal data for any purpose other than operating the Platform. Your data is yours — you may request a copy or deletion at any time by contacting info@andcap.com.au.
5.3 AndCap complies with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs). Our full Privacy Policy is available at joincommand.com/privacy.
5.4 In the event of a data breach likely to result in serious harm, AndCap will notify affected users and the OAIC in accordance with the Notifiable Data Breaches scheme.
6. Intellectual Property
6.1 All content, design, code, branding, and materials on the Platform are the intellectual property of AndCap and are protected under applicable Australian and international IP laws.
6.2 You may not copy, reproduce, distribute, or create derivative works from any part of the Platform without prior written consent from AndCap.
6.3 You retain ownership of all data you enter into the Platform.
7. Subscriptions and Payments
7.1 COMMAND is offered on a subscription basis. Pricing is displayed at joincommand.com.
7.2 Free trials are offered at AndCap's discretion. At the conclusion of a trial, continued use requires a paid subscription.
7.3 Payments are processed via Stripe. AndCap does not store your payment card details.
7.4 Refunds are available at AndCap's discretion for unused periods where a legitimate reason is provided. Contact info@andcap.com.au.
8. Acceptable Use
You agree not to: use the Platform for any unlawful purpose; attempt to reverse-engineer or copy any part of the Platform; share your account credentials with third parties; upload false or malicious data; or attempt to gain unauthorised access to other users' data.
9. Termination
9.1 You may cancel your subscription at any time by contacting info@andcap.com.au.
9.2 AndCap reserves the right to suspend or terminate your account without notice if you breach these Terms.
9.3 Upon termination, you may request a copy of your data within 30 days.
10. Governing Law
These Terms are governed by the laws of Queensland, Australia. Any disputes will be subject to the exclusive jurisdiction of the courts of Queensland.
